1. Heritage Craft requires CIA payment by cash, check, credit card, or ACH before any goods or service will be delivered. An additional 3%
service charge will apply to credit card payments.
2. Customers paying by check must also provide picture ID and credit card information/authorization to guarantee payment if a check is
returned. For all returned checks, a second secure payment will be requested within 7 days or HCC will process the payment via the credit
card on file and include an additional 3% service charge and an additional 15% late fee.
3. All sales conditioned upon acceptance of Heritage Craft. Terms and Conditions of Sale. Accordingly, Applicant (referred to as “Buyer”) accepts
and agrees to Heritage Craft. Terms and Conditions of Sale.
4. I authorize Heritage Craft LLC to charge the credit card provided herein in accordance with the issuing bank cardholder agreement.
1 Heritage Craft -Terms and Conditions
All sales made by Heritage Craft (“Seller”) to the Buyer (“Buyer”) are expressly conditioned on Buyer’s acceptance of the following
terms and conditions. Seller will not be bound by any terms of Buyer’s Purchase Order or other acknowledgement form that are
inconsistent with the terms herein. These terms and conditions may only be amended or waived in writing signed by an authorized
representative of Seller. Neither Seller’s commencement or performance nor delivery shall be deemed or construed as acceptance of
Buyer’s additional or different terms and conditions.
Order and Order Acceptance
All purchase orders shall reference these terms and conditions. Once the Seller receives the order, they will check inventory to ensure
everything is in stock. Please note that the Seller will only hold the purchase order for 24 hours. If no confirmation from the Buyer is
received within that time, the order is considered expired. No purchase order shall be binding upon Seller until accepted in writing by
Seller, and Seller shall have no liability to Buyer with respect to purchase orders that are not accepted. Buyer shall submit purchase
orders to Seller in accordance with Seller’s lead times then in effect. Once a Seller accepts a purchase order, a Sales Order will be
issued.
Pricing
All quoted pricing is valid for 30 days from issuance of quote. If the shipment date of the product is not within 30 days of the date of
the Sales Order, all prices set forth herein are subject to adjustment by Seller in accordance with its pricing policies in effect at the
time of shipment. Changes and adjustments to pricing policy supersede any previous pricing. All prices are subject to change without
notice.
Sales and Similar Taxes
HCC Cabinetry is a wholesaler and the final seller of a product is responsible for collecting and paying applicable taxes on products
purchased because the end consumer will pay sales tax on these items at the point of purchase.
Changes and cancellation
After acceptance by the Seller, the Buyer’s order is not subject to cancellation, change, reduction in amounts, or suspension or delay
of shipment, except with the Seller’s written consent. The Buyer at any time, by a written order, may request changes within the
general scope of this contract; however, no changes are effective without written consent of Seller. If any such changes cause an
increase or decrease in the cost of, or the time required for, any part of the work hereunder, an equitable adjustment shall be made by
Seller by written Sales Order amendment to the price or delivery schedule, or both. Cancelled orders consented to by the Seller are
subject to cancellation charges, based upon all expenses incurred by the Seller up to the time of cancellation. This includes excess
inventory of stock items that have been specifically allocated to the Buyer and exceed normal Seller inventory levels for a period.
Seller may cancel the order in the following cases: The Seller’s costs have exceeded selling price to Buyer; the Seller is unable to
provide product due to factors beyond the Seller’s control. Products held for the Buyer shall be at the risk and expense of the Buyer.
Returns and Exchanges
Heritage Craft only accepts RTA returns/exchanges in good, reusable conditions and in original packaging within 30 days of sale.
Assembled, modified or special ordered cabinets cannot be returned or exchanged. If HCC shipped the wrong cabinet, HCC will take
back the wrong cabinet in any condition. All returns and exchanges are subject to inspection and a 25% restocking fee. All returns will
be reimbursed as credit on the account and will apply to the next order. HCC cannot accept returns or exchanges on accessories
(Fillers, Moldings, Skins, Panels, Mullion Doors and anything else listed under accessories) due to how easily they can be damaged
during the return process. The Buyer will be responsible for the return/exchange shipping cost.
Delivery, Shipment, Pick-up and Acceptance
On average, lead time for RTA (Ready to Assemble) cabinets is 4-6 days and 6-8 days for assembled cabinets. Please note that lead
time does not include shipping time. The Seller reserves the right to extend lead time in case of order changes, backed up orders,
receiving inventory days, etc.
PICK-UP - 8:30AM AND 4 PM, MONDAY THROUGH FRIDAY.
If no request to expedite the order is made and accepted by the Seller, the pick-up date will be scheduled based on the Seller’s lead
time. The Seller will contact the Buyer once the order is ready, however it is recommended the Buyer calls to confirm the time before
picking up. The Seller shall use reasonable efforts to deliver Products in a timely manner, provided, however, that all delivery dates
are estimates and deliveries may be made in installments. All Products delivered will be packaged in accordance with Seller’s
standard practice or mutually agreed upon method and include itemized packing slips.
2 LIMITED WARRANTY - IMPORTANT
(AS STATED IN SELLER’S CATALOG AND WEBSITE):
Heritage Craft Cabinetry products are warranted to the original purchaser to be free from defects in materials and workmanship for a
period of five years from the date of possession. Please note any damage under the following circumstance your purchase would not
be covered by our warranty: products have been mishandled, misused, abused or improperly installed; color or pattern change and
occurrence of cracks due to improper storage under extreme temperature/moisture level, accidents after receiving, on-site alterations
or normal wear and tear. This warranty obligation is a limited warranty and is for the repair, replacement or credit adjustment of the
defective components, but it does not cover the cost of installation, removal, subsequent damage or transportation of the defective
products. This warranty does not apply to any products used in conjunction with the cabinetry, such as counter-tops, appliances or
plumbing fixtures. Heritage Craft Cabinets are constructed from several pieces of solid wood and veneer edged plywood panels.
Wood products’ natural characteristics vary in grains and colors, differences in grain patterns and colors should be expected. Mineral
streaks and knots in the wood are not considered defects. Color variations and color softening in cabinets are natural occurrences
depending on type of wood used, ages of the cabinets and the exposure to UV light and sunlight. For such instance, new/replacement
cabinets may not match display samples or existing cabinets. And such variation and color changes are not considered defects. This
warranty only applies to defects that do not involve color changing and aging of any wood products. Mitered door joints are more
likely to react to conditions of its environment. Gaps that occur between door joints due to environmental factors are not subject to
replacement under this warranty. Painted finish reacts differently than stained finish. With normal wood movement and climate
changes, cracks may appear in between joints or panel lines. These are considered as normal occurrences and are not covered under
this warranty. Cabinet doors that are warped must be allowed to hang through one full heating season (i.e. through full summer)
before replacement will be considered under this limited warranty. Doors that are warped not exceeding 1⁄4” do not meet normal
material expectation and are not covered under this warranty. HCC periodically makes changes to its product lines and specifications.
If a warranty claim is filed for a discontinued or unavailable item, HCC will replace the part(s) under warranty with a new part(s) of the
same style or with a similar style currently offered. HCC cannot be held responsible for not being able to match replacement with
originally installed products.(Flooring and Countertops have separate warranty policies.)
WARRANTY CLAIMS: DELIVERING DAMAGE CLAIMS:
All items must be inspected immediately upon receipt for any visible damage. Any damage to the items or missing packages must be
noted on the carrier’s freight bill and submitted directly to the carrier. We strongly recommend our customers to open all the boxes
within 10 days of the delivery, any concealed damage or errors shall be made by the buyer in writing to our customer service
department and a clear photo may be requested. Failure to make any claims accordingly shall constitute an irrevocable acceptance
of the goods and no claims will be accepted 10 days after delivery. Any damage claims must be made prior to assembling and
installation. After we verify the damage, we will arrange the replacement within 7 days of the claim made.
MANUFACTURING DEFECT CLAIMS:
Manufacturing defect claims cannot be made directly to Heritage Craft from the final purchasing group. The purchaser must contact
the original distributor, dealer or independent contractor where the purchase was made from. The distributor, dealer or independent
contractor will obtain the right to decide the necessity on filing claims and forwarding information in writing to Heritage Craft.If the
original distributor, dealer or independent contractor no longer exist as a business entity, please submit your claim in writing with a
proof of purchase directly to Heritage Craft reserves the right to determine the most cost effective and efficient method to correct
defective item. Heritage Craft and its manufacturer determine what is “defective” not the customer. If a manufacturing defect does
occur within the terms and conditions of this warranty Heritage Craft will replace the defective item within 7 days after the claim is
processed.
Notice to Consumer Buyers: Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may
not apply to you. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation
or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from
state to state.
